Mujib’s Case Transferred Form SDO’s Court

Mr. Justice Baquer and Mr. Justice Sobhan Chowdhury of the Dacca High Court though turned down the prayer of Sheikh Mujibur Rahman to quash some proceedings against him, however, transferred the case from the Court of the Sub-divisional Officer (North) Dacca to any other Court of Munsiff-Magistrate by their judgment delivered on Friday.
The proceedings which were popularly known as “pamphlet case” were started against Sheikh Mujib and five others in the Court of the aforesaid Sub-divisional Officer on the allegation made by the Officer-in-Charge of the Savar Police Station.
Sheikh Mujib and three others sought the quashing of the proceedings as they alleged that there were no substance in the allegations made against them by filing a petition in the High Court. Mr. Mujib filed another petition in the High Court for the transfer of the case from the Court of the aforesaid Sub-divisional Officer, Dacca to the court of any other Munsiff Magistrate in the District as he felt prejudiced to be tried by the officer.
The Officer-in-Charge of the Savar Police station complained on March 16 last year to the effect that Sheikh Mujib. Shah Azizur Rahman, Mr. Tajuddin Ahmed and Mr. Shamsul Islam were also connected with the incident that took place on the Dacca- Savar Road on January 21 last year in connection with which proceedings had already started against two other persons. The incident was that when the Provincial Governor was returning from Savar on that day in the afternoon the accused were proceeding towards Savar and from a jeep some unauthorised pamphlets were thrown at the window screen of the Governor’s car which caused fear and annoyance to the Governor, the Deputy Commissioner and other persons of the Governor’s party.
The plea of Sheikh Mujib and three others who filed the quashing petition was that they were proceedings for Savar at that time to ease the tension if there were any due to civil disturbance there and they were unaware of the Governor’s visit. They further alleged that they were not connected with anyone who threw pamphlets at the Governor’s car and the proceedings had already been started against two persons in this connection.
They submitted that on the inclusion of their names in the proceedings of that case after lapse of about two months of the incident were mala fide and motivated.
The proceedings were started against them under the Press and Publications Ordinance for allegedly possessing and distributing unauthorised pamphlets and under the Pakistan Penal Code for causing fear and annoyance to the Governor’s party.
The Court, however, refused to quash the proceedings at this stage but allowed the prayer of Sheikh Mujib to transfer the case as stated above.
