Mujib and brother acquitted

DACCA, May 31: Sheikh Mujibur Rahman, a former Provincial Minister and General Secretary of the defunct Awami League, was today acquitted of the charge of Misusing official power and position for obtaining pecuniary advantage.
His brother, Sheikh Abu Nasser, who was also facing trial along with his brother on the charge of abetment, was also acquitted.
The judgment was delivered by the Special Judge, Dacca division, Mr. A. S. M. Rashed.
In all, 15 prosecution witnesses were examined in the case. Two of them were the partners of the Al-Amin Industries and the rest were Government officers including Police officers. The prosecution story in brief was that Sheikh Abu Nasser, by assuring the partners of the Al-Amin Industries that he would secure for them a permission to set up a calendering plant, became one of their partners without investing any capital and ultimately he secured the permission through his brother, accused Sheikh Mujibur Rahman, who was the then provincial Commerce, Labour and Industries Minister. The prosecution further alleged that Sheikh Mujibur Rahman had accepted from the partners of the Al-Amin Indusrties a sum of Rs 1,500 subscription to Awami League funds.
JUDGMENT
The Special Judge, in his judgment, did not agree with the defence who challenged the jurisdiction of the court to try the present case on the ground that a Minister was not a public servant. The court held that Minister was a public servant and hence it had jurisdiction to try the present case.
