Brohi meets Mujib: Special Tribunal proceedings will be challenged

Mr. A. K. Brohi, advocate of the Supreme Court, will challenge the validity of the proceedings of the special tribunal now hearing the case state versus Sheikh Mujibur Rahman and others shortly in view of the restoration of fundamental rights following the withdrawal of emergency.
Mr. Brohi told me on Sunday evening that he held an interview with Sheikh Mujibur Rahman in the morning in the military custody and held professional talks with him. He said that a demand of justice has already been served on the Government of Pakistan challenging the constitutional validity of continuance of proceeding before the tribunal.
PPI adds: Mr. Brohi had travelled to Dacca in order to confer with the defence counsels and to advice them with regard to the constitutionality of the continuance of the proceedings before the special tribunal.
In view of the imminent withdrawal of the proclamation of the emergency the contentions that is being raised is that in view of the restoration of the fundamental rights following upon withdrawal of the emergency the ordinance under which the tribunal was constituted will be hit by the fundamental right number 15 of the constitution which guarantees equal protection of law to all citizens.
A demand of justice notice has already been served on the Government of Pakistan challenging the constitutionality of the continuance of the proceeding before the special tribunal after February 17, 1969, it was gathered from Mr. Brohi .
