Subject : Conduct of Government Servants.
Instances have come to the notice of Government in which Government servants in particular from the Nilkhet and Palassey Barracks, Dacca have organised and attended public meetings in order to ventilate alleged grievances, and have sometimes taken matters into their hands to redress these grievances. Government are fully aware of the inconveniences with which Government servants have had to put up on transfer to Dacca. They have already removed most of them and are prepared always to remove any of the legitimate grievances brought to their notice. They will not however to break in discipline among their servants. Government therefore desire that it should be impressed upon every Government servant that their grievances should be submitted for redress to the proper authorities in a regular manner, and the organisation of public meetings and agitations and the taking of other actions to coerce Government offend against the provisions of the Government Servant’s Conduct Rules to which every Government servant is subject. Government would be reluctant to take drastic disciplinary action against its servants and trust that they will realise that such agitation is against their own interest.
It is their intention however to take firm disciplinary action to deal with any contravention of the Government Servant’s Conduct Rules.
It is requested that this circular be communicated to all staff under your control.

Memorandum No. 1139 G. A., dated, Dacca, the 24th December, 1947.
Subject: Conduct of Government Servants : Taking part in Political Controversies.
Instances have come to the notice of Government, of Government Servants taking part in public demonstrations or public meetings or issuing press statements for or against the adoption of Bengali as the State Language of this Province. This controversy has assumed a political complexion. It is, therefore, no longer permissible for any Government Servant to take part in this or any other political controversy publicly. Government Servants doing so, will render themselves liable to disciplinary action for offending against the provisions of the Government Servants’ Conduct Rules.

Government Servants’ Conduct Rules
1. “17. Communication of official documents or information :
A Government servant may not, unless generally or specially empowered by Government in this behalf, communicate directly or indirectly to Government servants belonging to other Departments, or to non-official persons, or to the Press, any document or information which has come into his possession in the course of his public duties, or has been prepared or collected by him in the course of those duties, whether from official sources or otherwise.”
2. “18 Connection with Press :
A Government servant may not, without the previous sanction of Government, become the proprietor in whole or in part, or conduct or participate in the editing or management of any
newspaper or other periodical publication.
3. “20. Criticism of Government and publication of information or opinion upon matters relating to foreign countries : (i) No Government servant shall, in any document published under his own name or in any public utterance delivered by him, make any statement of fact or opinion which is capable of embarrassing :
(a) The relations between Government and the people of
Pakistan or any section thereof, or
(b) The relations between Governor General in Council and any foreign country or the ruler of any state in Pakistan.
(ii) A Government servant who intends to publish any document under his own name or to deliver any public utterance containing statements in respect of which any doubt as to the application of the restrictions imposed by sub rule (1) may arise shall submit to the Government under which he is serving a copy of document which he intends to publish or of the utterance to deliver, and shall not publish the document or … save with the sanction of the Government under which … with such alteration, if any as the Government made.
4. “23 Taking part in politics and elections :
(i) No Government servant shall take part in, subscribe or assist in any way, any political movement in Pakistan, or to Pakistan affairs. Explanation : The expression ‘political movement includes any movement or activities tending directly or indirectly to excite disaffection against, or to embarrass, the Government as by law established, or to promote feelings of hatred or · enmity between different classes of Pakistan subject or to disturb public peace.
(ii) No Government servant shall permit any person dependent on him for maintenance or under his care or control to take part in, or in any way assist, any movement or activity which is, or tends directly or indirectly to be subversive of Government as by law established in Pakistan. Explanation : A Government servant shall be deemed to have permitted a person to take part in or assist a movement or activity within the meaning of clause (ii), if he has not taken every possible precaution and done everything in his power to prevent such person so acting or if, when he knows or has reason to suspect that such person is so acting he does not at once inform Government or the officer to whom he is subordinate.” Explanation : “The expression “political movement” includes any inovement or activities tending directly or indirectly to excite disaffection against, or to embarrass, the Government as by law established, or to promote feelings hatred or enmity between different classes o Pakistan subject or to disturb the public peace.”

The question has been raised whether Government Servants should be allowed to participate in the activities of the Jamat-i-Islami sponsored by Maulana Abul Ala Moududi of Lahore. I am to say that as the Jamat-i-Islami, is a political movement, Government servants should not, in view of the provision of rule 23 of the Government Servant Conduct Rules, participate in its activities. I am to request that this may be brought to the notice of your officers and staff.

In June, 1949, a number of subordinate employees (Junior Assistants, Orderlies, etc.) hailing from West Bengal applied to Government requesting that they should be allowed to re-opt for services in West Bengal in view of difficulties of looking after their properties and families in West Bengal and of the fact that in the eyes of some of their colleagues failing from East Bengal their loyalty to Pakistan was suspected. They were informed that Government was unable to accept their request. Subsequently, some of these misguided employees took out a procession in Dacca demanding that they should be allowed to re-opt for services in West Bengal. A few days later a letter appeared in Azad and Zindigi purporting to have been written by ‘sufferers’, inviting the attention of the Premier and Chief Secretaries of East Bengal and West Bengal to permit re-option to employees who wanted to serve in the other Province
Government strongly disapprove public agitation or representation by employees hailing from West Bengal for being allowed to re-opt to serve in West Bengal. Such representation or agitation would not alter the position as regards options but would merely provide material to enemies of Pakistan to decry it. Government desire that these facts be made widely known among such employees and they should be warned that such agitation or representation shall in future be taken as indicative of disloyalty to Pakistan and render such employees liable to dismissal from service.

The Government have for sometime been watching the activities of the Progressive Writers’ Association in Pakistan and are now satisfied that it is definitely a political organisation. It has, therefore, been decided that the Government servants should not, in view of the provisions of Rule 23 of the Government Servant Conduct Rules, become members of the Association or participate in its activities.
